!BIRTH-MARRIAGE-DEATH: SEARS NOTES; 1782-1890; June Rayfield Welch, Dallas, TX; pp 7-11; copy in poss of Ray Sears, Duncan, OK ; On 20 Dec 1819, David Wilson made James Sears his attorney to sellIndiana land[29-Whitley co, KY Deed Book 1, p 11]. In the 1820 Northeast twp, Orange co, IN census JBS and Jane, 16-25, had three boys and a girl under 10 and farmed near John Sears. In 1827 he moved to Saline co, MO, where he was listed in the Nov 1830 census: #234 James B Sears, Arrow Rock twp, was on the page with Benjamin Jones, Nathaniel Walker (Jane's brother), Hardin Nave, George Nave, James and John Sappington, and William beaty. Elizabeth Prigmore, mother of Daniel and Dorcas, was 8 pages away. In 1831, Sears was an original settler of Rives co; brothers-in-law Pleasant and George W Walker, arrived in 1832. Formed in 1834 from Lafayette, Rives became henry co in 1841[30-History of St Clair and Henry cos, MO, 1883, pp 114, 139, 140, 319]. On 4 Aug 1835 JBS was surety for Sheriff Joseph Fields. A 2 Aug 1836 petition signed by Seaers, John Y Sharp, Peyton Parks, Charles C Harris, B F Wallace, Alfred Jack, Isaac Swift, John nave, William Swift, Willis Bush, Fielding A Pinnell, Robert Brown, Moses Stansberry, GW Lake, and G W Walker sought a survey to widen the road from Johnson co line at the "high point of post oak thence running to a point designated for the present county seat of this county thence to continue south to the county of St Clair." In Nov, John M Reid and James B Sears reported on their survey[31-Henry co, MO Court Minute Book 1]. On 28 Nov 1836, Rives commissioners "ordered that James B Sears(deputy sheriff) be allowed $8 for viewing and marking road from high point of Post Oak to the Osage River." On 16 Jan 1837, John Rank, of Teabo twp, farmer, gave Sears, of Grand River twp, henry co, a deed of trust on a wagon, 2 work horses, a sorrel mare, 3 yoke of oxen and a black mare. In May 1837 Sears, John M Reed, and Willis Bush were election judges in Grand River twp. In Jun 1837 Sears' Clinton home was used as a courtroom, for which the county paid $6 rent. On 28 mar 1838, Sears bought lots 15 and 16 in Clinton for $74. The deeds were signed by John F Sharp, commissioner[32-Henry co Deed Book A, p 70]. In Oct and Nov of 1838 Sears patented two parcels and a third of a half section with Pleasant and George Walker. On 16 Nov 1838, Sears entered E 1/2 of SW 1/4 of S 3, T 41, T 26, per cash certificate 13,235, and patent was issued 1 May 1843, and signed by John Tyler. The house believed to be the oldest in Clinton stood on this grant. JBS and Jane sold to Jennings Beckwith on 25 May 1839[33-Henry co Deed Book 29, p 167]. In 1838 Sears moved to a thousand acres (worth $1.25 an acre) at Altona, bates co and built a two-story, double log house. On 25 may 1839, JBS and Jane sold Jennings Beckwith several Rives co lots for $1,500. In Jun and Aug JBS platted land in Henry co. On 28 Sep 1840, Francis A Sears sold to JBS, both of Van Buren co, MO, 40 acres in T 42, R 30 in present Bates co. (Francis had bought in 1839; he may have caused JBS, wife and 11 children to move there, to Section 33, Grand River twp) On 23 Oct 1841, JBS sold land to J S Swift. On 27 Oct 1841 JBS sold land to Isaac F Swifr. (Isaac Swift mortgaged land to Rebecca Prigmore, Isaiah's widow, on 20 Feb 1851.)[34-Henry co Deed Book D, pp 381, 384, Book E, p 332]. On 16 Mar 1842, JBS sold to Pleasant and George W Walker and sold land in T42, R30 to Franklin Sears. At the Apr 1842 term, these actions were filed in Cass co Circuit Court: Elias Sears v Robert Davis and Fleming Davis, trespass vi et armis; Fleming Davis v James B Sears; and Robert Davis v James B Sears, tresspass vi et armis. At the Jul 1842 term a manslaughter indictment against James B Sears was deferred to the next term. No Sears or Prigmore was on the 1845 Henry co tax roll except for Franklin's Lots 80 and 81[35-Betty Williams, Henry co, MO Assessor's Book, 1845-1977, Warrensburg, MO:1977]. On 13 Apr 1849, JBS, as attorney for Franklin Sears, sold two Clinton lots to Joseph Reid[36-Henry co Deed Book E, p 98]. In 1849 JBS d of cholera at Ft Kearney, NE en route to the CA gold fields. Jane, George, Sarah, and Minerva returned to live in S11, Shawnee twp, Bates co, MO. Although not mentioned in T C Berry's "Across the Plains in 49," Sears may have belonged to that same party. Led by J C Hays, it probably left Pettis 19 Apr 1849 - the day Sears sold his land in Bates and Henry co. On 26 Apr, he sold the balance of Franklin's real estate. The 80 or 90 in the Berry party included Isaiah Prigmore - who died in Panama on his way home - and a Knaus. After they left Independence, others joined. Crossing the state line on 1 May 1849were 21 wagons with 7 men to the wagon - a total of 147. They reached the mines 1 Sep 1849.
